Template, review by qualified counsel before publishing. Replace every [bracketed] placeholder. A Swedish-language version is required for consumers, and mandatory Swedish/EU consumer-protection rights cannot be waived. *Last updated: [date].*These Terms of Service ("Terms") govern your use of the website vattenlarmet.se and the water-leak alarm notification service (the "Service") provided by Partsnord Europe AB, Torshamnsgatan 27, SE-164 40 Kista, Sweden ([org.nr 559XXX-XXXX]). By creating an account or using the Service, you agree to these Terms.
1. The Service
The Service receives valve-status data from LoRaWAN devices and sends notifications (SMS and email) to the recipients you configure when a water-leak alarm condition is detected, when it clears, and when a device goes offline.
2. Not a safety device, important
The Service is a supplementary reporting layer ("Layer 3"), not a safety function. The physical water-shutoff valve closes the water independently of the Service and does not depend on it, the internet, or any notification being delivered. The Service does not stop leaks and does not replace physical protection, insurance or supervision. We do not warrant that notifications will be delivered, delivered promptly, or received. You must not rely on the Service as your sole or primary means of detecting or preventing water damage.
3. Accounts and roles
The Service uses role-based accounts: Customer (company or private individual), Admin (Partsnord operations) and Super Admin. You are responsible for the accuracy of your account information, for keeping credentials confidential, and for all activity under your account. You must be at least 18 years old or have authority to bind the organisation you represent.
4. Your responsibilities
- Provide and maintain accurate recipient details (phone numbers, emails).
- Ensure you have a lawful basis and the necessary consent to enter other
people's personal data (e.g. caretakers, residents) and to have us send them messages on your behalf. For business customers, this is governed by the Data Processing Agreement (DPA).
- Use the Service lawfully and not misuse, probe, overload or attempt to gain
unauthorised access to it.
- Keep device hardware and installation in good working order (installation and
the physical valve are outside the scope of these Terms unless separately agreed).
5. Availability and changes
We aim for high availability but do not guarantee uninterrupted, error-free operation. The Service may be unavailable due to maintenance, third-party providers (e.g. SMS/email carriers) or events beyond our control. We may modify or discontinue features, giving reasonable notice of material changes where practicable.
6. Fees
[Describe subscription fees, billing cycle, taxes, renewal and cancellation, or state that the Service is provided under a separate commercial agreement.]
7. Intellectual property
The Service, the Site and all related software and content are owned by or licensed to Partsnord Europe AB. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. You receive no other rights.
8. Personal data
We process personal data as described in the Privacy Policy and, for business customers, the Data Processing Agreement.
9. Limitation of liability
To the fullest extent permitted by law, Partsnord is not liable for indirect or consequential loss, or for loss arising from delayed, undelivered or unreceived notifications, from reliance on the Service contrary to clause 2, or from third-party carriers. Nothing in these Terms limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence, fraud, or mandatory consumer rights). Where liability is permitted to be capped, our total liability is limited to [the fees paid in the preceding 12 months]. Consumer note: if you are a consumer, your mandatory rights under Swedish and EU consumer law are unaffected by these Terms.
10. Term and termination
These Terms apply while you use the Service. Either party may terminate as set out in the applicable commercial agreement or, for consumers, in accordance with mandatory law. On termination we will delete or return personal data as described in the Privacy Policy / DPA.
11. Governing law and disputes
These Terms are governed by the laws of Sweden, and the courts of Sweden have jurisdiction. Consumers may also bring proceedings in their country of residence and may use the National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) and the EU Online Dispute Resolution platform.
